These terms are an agreement between you and Pro Trader Academy LLC (“Pro Trader”, “we”, “us”). They cover protraderx.com, our member area at school.protraderx.com, and all of our courses, tools, indicators, community, and coaching (together, the “Services”). By using the Services you agree to these terms and to complying with the laws that apply to you. If you do not agree, do not use the Services.

1. Subscriptions and access

An active Pro Trader subscription is required to access our products, including but not limited to Pro Trader: Ultimate, Pro Trader: Playbook, Pro Trader: Archives, Trade Spotters, and all coaching-related products. It is your responsibility to keep your payment method current so that the direct debit is honored on its due date. Access that is tied to your subscription, including invite-only TradingView indicators, ends when your subscription ends.

2. Refund policy

Refund eligibility varies by product and is stated at the point of sale. If nothing is stated at the point of sale, the general refund policy below applies.

Some products may be deferred to a later date on request. Deferrals are considered case by case and are not guaranteed.

3. License to use our materials

We grant you a personal license to temporarily download one copy of any downloadable materials for personal, non-commercial viewing only. This is a license, not a transfer of ownership. Under this license you may not:

• modify or copy the materials;
• use the materials for any commercial purpose or public display;
• attempt to decompile or reverse engineer any software in the Services;
• remove any copyright or other proprietary notices; or
• transfer the materials to another person, share your access, or mirror the materials on any other server.

This license ends automatically if you breach any of these restrictions, and we may end it at any time. When it ends, you must destroy any downloaded materials you hold, in electronic or printed form. Everything in the Services is protected by applicable copyright and trademark law.

4. Education only. Not financial advice

The Services and everything in them are general information and education. Nothing in them is, or should be read as, advice, guidance, or a recommendation to take or not take any action, including in relation to investments or the purchase or sale of any currencies, securities, shares, or other assets of any kind.

There is a very high degree of risk involved in trading. Do not trade with money you cannot afford to lose. Past performance is not indicative of future returns. The information and content provided is impersonal and not adapted to any particular person, business, or investment program. You are solely responsible for your financial, investment, and trading decisions. Nothing in the Services is a substitute for professional financial advice, and if you act on anything in them, you do so entirely at your own risk. It is your responsibility to obtain professional, specialist, financial, or investment advice before taking or not taking any action based on our content.

Luke Lawson, Pro Trader, its affiliates, and their representatives are not responsible or liable for the accuracy, usefulness, or availability of any information in the Services, or for any trading or investment decisions made based on that information.

5. No warranties

The Services are provided on an “AS IS” and “AS AVAILABLE” basis, without warranties of any kind, express or implied, including implied warranties of merchantability, fitness for a particular purpose, non-infringement, and course of performance, except where the law does not allow those warranties to be excluded. We do not warrant that the Services will be uninterrupted, secure, or available at any particular time or place, that errors or defects will be corrected, that the Services are free of viruses or other harmful components, or that the results of using the Services will meet your requirements.

6. Limitation of liability

To the fullest extent the law allows, Pro Trader is not liable for any damages arising out of the use or inability to use the Services or the materials in them, including without limitation damages for loss of data or profit or business interruption, even if we or an authorized representative have been notified, orally or in writing, of the possibility of such damage. Some jurisdictions do not allow limits on implied warranties or on liability for consequential or incidental damages, so these limits may not apply to you.

7. Our rights are not waived

If you breach these terms and we choose not to act immediately, or not to act at all, we are still entitled to all of our rights and remedies at any later date or in any other situation where you breach them. We are not responsible for any breach of these terms caused by circumstances beyond our control. A person who is not a party to these terms has no rights of enforcement, and you may not assign, sub-license, or otherwise transfer any of your rights under them.

8. Accuracy of materials

The materials in the Services may include technical, typographical, or photographic errors. We do not warrant that any of the materials are accurate, complete, or current, and we may change them at any time without notice. We do not commit to updating them.

9. Links to other sites

We have not reviewed all of the sites linked from the Services and are not responsible for the contents of any linked site. A link does not mean we endorse the site. Using any linked site is at your own risk.

10. Changes to these terms

We may revise these terms at any time without notice. By using the Services you agree to be bound by the version of these terms current at the time you use them. The latest version will always be at protraderx.com/terms.

11. Governing law

Any claim relating to the Services is governed by the laws of the State of Delaware, United States, the home jurisdiction of Pro Trader Academy LLC, without regard to its conflict of law provisions.

12. SMS text messaging

If you give us a mobile number and opt in to text messages on one of our forms, Pro Trader Academy LLC (“Pro Trader”) may send you recurring text messages tied to that program, such as event reminders, join links, session confirmations, and marketing messages about our courses and offers. Message frequency varies depending on the program and the sessions you register for. Message and data rates may apply. Wireless carriers are not liable for delayed or undelivered messages.

Opting in to text messages is always a separate, optional choice and is never a condition of registering, booking, or buying anything from us. You can opt out at any time by replying STOP to any text, and you will stop receiving messages from that program. Reply HELP for help, or contact us at [email protected].
